These Terms of Service ("Terms") govern your use of the EaziSell website and the services provided by EaziSell. By accessing our website, submitting an order, creating an account or using our services, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use our website or services.

1. About Eazisell

EaziSell provides digital marketing and content creation services designed to transform customer-provided vehicle and property listing images into professional marketing video content.

Our services may include:

Vehicle marketing videos
Property marketing videos
Listing promotional content
Social media-ready content
Other digital marketing services offered through the EaziSell website

The specific service provided to you will depend on the service or package selected when placing your order.

2. Using Our Services

To use certain EaziSell services, you may be required to provide personal, contact and listing information.

You agree that all information you provide to EaziSell is accurate, complete and up to date.

You are responsible for ensuring that the information you provide allows us to properly process your order.

EaziSell reserves the right to contact you if additional information is required to complete your order.

3. Submitting an Order

When you submit a service request through the EaziSell website, you are requesting that EaziSell provide the selected service based on the information and content you have supplied.

Submitting an order does not necessarily mean that EaziSell has accepted the order or that a payment is immediately due.

EaziSell may review the submitted information and contact you if there are any issues with the request.

Once your request has been accepted, we will begin processing it according to the applicable service.

You are responsible for ensuring that you have the necessary rights, permissions or authorisation to use any images, videos, logos, trademarks or other content that you upload to EaziSell.

By uploading content to EaziSell, you confirm that:

You own the content or have permission to use it.
Your use of the content does not infringe another person's intellectual property rights.
The content does not knowingly contain unlawful or fraudulent material.
The content is not intended to mislead potential buyers.

You grant EaziSell permission to use the submitted content solely to the extent reasonably necessary to provide the services you have requested.

This may include storing, accessing, editing, processing and transferring your submitted content to authorised service providers involved in producing your requested marketing content.

4. Images and Content You Provide

5. Quality of Submitted Images

The quality of the final marketing video may depend on the quality, resolution, lighting, composition and suitability of the images supplied by the customer.

EaziSell recommends providing clear, high-quality images that accurately represent the vehicle or property being advertised.

EaziSell is not responsible for limitations in the final result that are directly caused by poor-quality, incomplete, misleading or unsuitable content supplied by the customer.

Where possible, EaziSell may contact you if the submitted content is unsuitable for processing.

EaziSell may use artificial intelligence, automated tools and third-party digital content creation technologies as part of the process used to produce marketing content.

The use of these technologies may affect aspects of the final output, including visual effects, transitions, image movement, composition or other creative elements.

You understand that AI-generated or digitally enhanced content may not reproduce every detail of the original images exactly.

EaziSell will make reasonable efforts to produce professional and visually appealing content based on the material provided.

7. Processing and Turnaround Times

EaziSell aims to process orders as efficiently as reasonably possible.

Estimated turnaround times may vary depending on:

The service requested
The number of orders being processed
The quality and quantity of submitted content
Additional information required from the customer
Technical issues or circumstances outside EaziSell's reasonable control

Any turnaround time provided by EaziSell is an estimate unless specifically stated otherwise.

EaziSell will make reasonable efforts to keep customers informed of significant delays.

8. Pricing

The price of a service will be communicated to you through the EaziSell website, quotation, payment request or other applicable communication.

Prices may change from time to time. Changes to pricing will not affect an order that has already been accepted unless otherwise agreed with the customer.

Additional services or requested work outside the original scope may incur additional charges.

Any additional charges will be communicated to the customer before the additional work is carried out where reasonably possible.

Payment must be made using the payment method provided by EaziSell.

EaziSell may use third-party payment providers, including Peach Payments, to process payments.

Payment must be successfully received before EaziSell is required to release or deliver a completed paid product, unless otherwise agreed.

A payment request or payment link may be sent to you once your requested marketing content is ready or has reached the applicable stage of completion.

9. Payment

10. Failure to Complete Payment

If payment is not received within the period specified in a payment request, EaziSell may:

Place the order on hold
Cancel the order
Remove the payment request
Delay delivery of the completed content
Require a new payment request to be issued

EaziSell may also contact you regarding an outstanding payment.

11. Delivery of Completed Content

Once payment has been successfully confirmed, EaziSell will provide the completed marketing content using the delivery method communicated to you.

The final content may be provided in a commonly supported digital format, such as MP4, depending on the service purchased.

Customers are responsible for providing a valid email address or other required delivery information.

EaziSell is not responsible for delivery problems caused by incorrect contact information supplied by the customer.

12. Revisions and Changes

EaziSell aims to deliver content that meets the agreed requirements.

If revisions are included with your selected service, you may request reasonable changes within the applicable revision allowance.

Revision requests must relate to the original service and submitted content.

Requests that require substantial additional work, completely different creative direction, new content or services outside the original order may be treated as additional work and may incur additional charges.

13. Customer Approval

Where EaziSell provides an opportunity to review content before final delivery, the customer is responsible for reviewing the content and communicating any reasonable changes within the applicable review period.

Once the applicable review or revision period has passed, EaziSell may consider the order completed.

14. Accuracy of Listing Information

You are responsible for ensuring that all vehicle, property and other listing information supplied to EaziSell is accurate.

EaziSell does not independently verify information supplied by customers, including:

Vehicle specifications
Mileage
Pricing
Property features
Property dimensions
Ownership information
Contact details
Availability
Claims made about a vehicle or property

EaziSell provides a marketing content creation service and does not act as the seller, estate agent, vehicle dealer or owner of the advertised property or vehicle.

15. Prohibited Content

You may not use EaziSell's services to create content that:

Is unlawful or fraudulent
Infringes another person's intellectual property rights
Contains intentionally misleading information
Promotes illegal activities
Contains defamatory or abusive material
Violates another person's privacy
Contains inappropriate or unlawful material

EaziSell reserves the right to refuse or suspend an order where submitted content appears to violate these Terms or applicable law.

16. Intellectual Property

EaziSell retains ownership of its website, branding, logos, software, processes, templates, designs and other materials created independently by EaziSell.

Unless otherwise agreed, customers retain ownership of the original images and information they provide to EaziSell.

Once the applicable service has been fully paid for, the customer receives the right to use the final marketing content delivered by EaziSell for the customer's intended marketing and promotional purposes.

This does not transfer ownership of EaziSell's underlying technology, templates, processes or third-party tools used to create the content.

17. Use of Completed Work

With your permission where required, EaziSell may use completed marketing videos or selected examples of its work for:

Portfolio purposes
Website examples
Social media
Marketing and promotional material

If you do not want your completed work used for promotional purposes, please contact EaziSell and we will consider your request in accordance with applicable law and our agreements with you.

18. Cancellation

If you wish to cancel an order, please contact EaziSell as soon as possible.

Where work has not yet started, EaziSell may be able to cancel the order without further processing.

If work has already started, cancellation may be subject to the nature and stage of the service and any applicable legal rights.

Any refund will be handled in accordance with applicable law and EaziSell's refund policy, where applicable.

19. Refunds

Because EaziSell provides customised digital services based on customer-provided content, refunds may depend on the circumstances of the request and the stage at which the service has been completed.

Nothing in these Terms is intended to remove or limit any consumer rights that cannot legally be excluded under applicable South African law.

Where a refund is approved, it will normally be processed using the applicable payment method or another agreed method.

20. Service Availability

EaziSell aims to keep its website and services available, but we cannot guarantee that the website will always be available or operate without interruption.

Temporary interruptions may occur because of:

Maintenance
Technical problems
Hosting or infrastructure issues
Third-party service outages
Internet connectivity issues
Security incidents
Circumstances outside our reasonable control

We will make reasonable efforts to restore affected services as soon as reasonably possible.

Customer behaviour

EaziSell's service is intended to improve the presentation and marketing of your listing but does not guarantee a particular commercial result.

23. Customer Responsibilties

You are responsible for:

Providing accurate information
Providing content that you are legally entitled to use
Reviewing your submitted information
Keeping your account information secure
Providing accurate contact and delivery information
Paying applicable fees
Using the final content lawfully
Ensuring that your advertised vehicle or property complies with applicable laws and regulations

24. Account Security

If you create an EaziSell account, you are responsible for keeping your login credentials confidential.

You should notify EaziSell if you believe that your account has been accessed without your permission.

EaziSell will not be responsible for unauthorised activity resulting from credentials being improperly shared or exposed by the customer, except where otherwise required by applicable law.

25. Privacy

Your use of EaziSell is also subject to our Privacy Policy, which explains how we collect, use, store and protect personal information.

By using EaziSell, you acknowledge that you have had an opportunity to review our Privacy Policy.

26. Changes to These Terms

EaziSell may update these Terms from time to time to reflect changes to our services, business practices, technology or legal requirements.

When changes are made, the updated Terms will be published on this page and the Effective Date will be updated.

Your continued use of EaziSell after the updated Terms have been published constitutes acceptance of the updated Terms, to the extent permitted by applicable law.
